Revolt in North Africa, it is time to reform the law on citizenship


The revolution under way in North Africa opens unpredictable scenarios. Humanitarian emergency could soon touch our country, with the arrival of many refugees. The Italian government is unprepared. Spreads fear to create alarm and escape responsibility. How long? The debate
immigration in the coming months may yet run out - as is the case for years - the interplay between public policy and more or less benevolent assistance of the newcomers? There is a risk that you do not speak more than one theme emerging from omitted time, high time: the plight of many immigrants who already live and work in Italy for years. We can continue to pretend that these are not people like us?

Italian law based on the allocation of national citizenship, a sort of "family law" is a national heritage by blood or by marriage. it may be still the case? Citizenship should not be acquired for the free and independent choice of those who decide to live here in our country and is committed to their jobs, their economic activities, their civic initiatives in building a common home open, welcoming and inclusive?
citizenship, without rights, belonging and participation, is not only "affair of state." It is based on the recognition of the human person beyond his ties to a specific community. Arises from the concrete and active rights, beyond their formal title. Is anchored to the international regime of human rights.

The Italian Constitution is in the lead: incorporates the Universal Declaration human rights, and with this, the protection of rights that are well ahead of those related to national citizenship. Just think of the right to health which the immigrants have: our NHS is bound to protect, even if they are not Italian (I explain the decisions of the Constitutional Court). In short, the rights of personality, based on constitutional and universal citizenship, are extended to all. And between the rights of freedom for excellence, guaranteed to all by the European constitutional treaty, are just the "right of abode" and "freedom of movement."

In many cases, then, citizenship becomes "active". According to the principle constitutional subsidiarity, all citizens, individuals or groups including immigrants, can exercise their rights, take responsibility in public life, to contribute to social development and civil place of residence. Conversely, the key management in security-immigration bureaucracy which undergoes the torment those who ask for or renew a residence permit, the state of limbo in which they are convicted of second-generation immigrants (Italians in effect) are forms of violence free, beautiful and good, a negation of humanity and the rights of these people.

There is much to do, then. But the first step now, is reform the law on citizenship should be more accessible to many who now reside here for years and are now Italian, too. The second step is a series of integration policies that remove obstacles to human development of all citizens, without distinction of any kind, even of ethnicity (it is the duty of the Republic under Article 3 of the Constitution). Finally, based on the principle of subsidiarity written in 118, measures are needed to welcome and encourage 'all' those people, often immigrants, who carry out activities of general interest. Even so, you will build an Italy more united, friendly, European Union. It would be worth remember that the government in 2011 in this special that celebrates the European Year of Active Citizenship and the 150 anniversary of the unification of Italy.
